1. Provider and scope

These Terms and Conditions apply to all contracts between

(hereinafter "Provider") and users of the podQuery service (hereinafter "User" or "Customer"). Any conflicting terms of the Customer shall not apply.

2. Service description

podQuery is a Software-as-a-Service (SaaS) platform that provides:

• Automated import of podcast episodes via RSS feeds and manual single-episode upload
• Transcription of audio content using state-of-the-art AI transcription models with speaker diarization, supporting automatic language detection and manual language selection
• AI analysis across 40 metrics organised in 6 tiers: content depth, factual density, engagement potential, communication clarity, actionability, and production quality — scored per speaker and overall
• Transcript cleaning: removal of transcription artefacts, repeated words, and mixed-language noise, without altering the meaning of what was said
• Readable formatted transcripts with table of contents and contextual links (Pro and Business plans)
• Speaking analytics: words per minute, filler word rate, hedging rate, lexical diversity, repetition rate, statements vs. questions ratio
• Full-text search via a vector database knowledge base
• API and MCP endpoint access (Pro and Business plans)
• One-time batch import of up to 1,000 episodes from the RSS feed history (Business plan)

3. Contract formation and registration

The contract is formed upon registration and completion of a subscription. By registering, the User confirms that they are at least 18 years old and accept these Terms and the Privacy Policy.

4. Plans and pricing

The following monthly subscription plans are available:

• Basic — €39.00/month: 10 episodes per month; AI transcription with speaker diarization; language selection; AI analysis (40 metrics, Tier 1–6); cleaned transcripts; speaking analytics; vector database knowledge base; public episode URLs
• Pro — €49.00/month: 35 episodes per month; all Basic features; readable formatted transcripts; MCP/API access
• Business — €79.00/month: 100 episodes per month; all Pro features; one-time batch import of up to 1,000 episodes from the RSS feed history

All prices are inclusive of applicable taxes. Price changes will be communicated by email at least 30 days before they take effect.

5. Payment and billing

Payment is made monthly in advance via Mollie Payments B.V. The subscription renews automatically each month unless cancelled in time.

6. Cancellation

The subscription may be cancelled at any time effective at the end of the current billing month via account settings or by email to contact@podquery.ai. Access remains active until the end of the paid period. No pro-rata refunds are issued.

7. Limitation of liability

The Provider is fully liable for intent and gross negligence. For slight negligence, liability is limited to foreseeable, typical damage arising from breach of material contractual obligations.

The accuracy, completeness, or quality of AI-generated transcriptions, summaries, or analyses is not guaranteed. These are machine-generated and may contain errors.

8. Privacy

Personal data is processed in accordance with our Privacy Policy.

9. Governing law

These Terms are governed by the laws of the Federal Republic of Germany. For disputes with merchants, the exclusive place of jurisdiction is Hannover, Germany.

10. Severability

If any provision of these Terms is found to be invalid, the remaining provisions shall continue in full force and effect.
